Terms of Use
It looks like I’m going to have to change my Terms of Use again, I have tried to make them as fair as possible but there’s always someone trying to take advantage. I may have to re-think the way I do everything as it’s not the first time this kind of thing has happened.
Up until now all of my files have been free but some people think that if I’m not going to charge then they will do it instead.
Turning on the TV and watching someone make thousands of pounds with my designs is a pretty big kick in the teeth.
Oh, my goodness, that is horrible! I, for one, have always appreciated your free designs, but I wholeheartedly understand if you need to change things to protect yourself. I am so sorry you have to go through these things.
That’s not cool at all Bird. I am so sorry someone is doing that. And I’m assuming they are claiming it as their own too?
I always give credit and info about the designer if I sell my handmade items. ALWAYS.
I wish I knew the website so I could give them a piece of my mind. I am so appreciative of your free files because as a pensioner I live on a tight budget but would totally pay if that is the way you need to go. So sorry someone feels the need to do that to you.
I imagine how painful that must be. Rest assured that you have many followers who do appreciate your work and are happy to credit you any time they use your designs.
I, for one, do not sell my handmade stuff, but I blog them, and I always credit you when I use one of your cut files. And I found your site following one of those credit links from another blog, so I know at least some others are respectful!

Sorry to hear about those who would take advantage. I love your stuff and use it for a lot of cards for soldiers and family, so I will miss not having so easy an access, but I totally get it, if anyone is making money from your hard work it should be you!
This disgusts, but unfortunately doesn’t surprise me. I have just recently found your site and have been delighted with the fabulous designs you have been giving away for free. I hate that someone is taking them and using them for personal gain. Could you share their website? I know a few people who would love to give them a piece of their mind and teach them some proper manners.
I hope you will continue to make the fabulous designs free, but understand if you feel you are no longer able.

I am retired and it was much Money for me and i am so happy that i have found your free cutting files.my english is not very well,but i understood what happend to you. i am very sad about this, because you such a nice Person ,you share your creative work with us! But there are always some bad People who shortchange (capitalize)good People like you.i can understand you.
like many others I have used your files and appreciate your generosity in sharing them, I always give you credit as the designer. I hate the fact that there are others that are exploiting you and you must do all you can to stop them .thank you for the hours of enjoyment you give us and the money you help us to raise from them

Whoever or wherever the money is going to, charity or not, does not give anyone the right to sell others’ designs, it is still stealing!
Sorry, I misread your reply. I assume you are talking about money raised from sale of cards made from Bird’s designs, which is commendable.
(I became a little paranoid as I have gone through what Bird is going through, after I made a CD of Iris Folding patterns and had them stolen, copied, passed around, etc.)
Have enjoyed your files and appreciated your generosity in sharing them freely.
It’s a shame this individual is taking advantage of you.
I hope you can “nail” this person thru your court system.

I appreciate your files and the work put into creating them, I am assuming that if you saw it on tv then am I wrong to assume it would be the 24/7 craft channel(no names mentioned). If so you should write a strong email to the producer and air your concerns to him.
I use your designs for my own personal use.

I also just have to say that I live in the states and am totally jealous that anyone has a 24/7 crafts channel!

Bird- Although I haven’t yet used any of your files I do look at your site daily. Your work is so nice and sometimes helps to inspire me when I create my own designs. I hope you can do something to stop this person from this misuse of your work.

THAT is DISGUSTING!!!! Why is it the FABULOUS people get trampled upon? Do people have no ethics left any more. I am so sorry this happened. I love your files…but they are for MY PERSONAL USE. I can’t imagine anyone doing that and on TV? WTF?

I found your link very recently because I bought a scan n cut and the blogs are all talking about your svgs I used 2 of your svgs last weekend for Father’s Day and the your a star svg and digi stamp for my daughters card for passing her exams I was very pleased with the results and immediately signed up to your forum so I could thank you and made a donation today when I was paid

Sorry this has happened to you and thank you for the free files you have shared. I wish for once and all a successful legal way can be found to prevent it this from happening. Far too often we read where a designer has stopped sharing files because some selfish thief has stolen and sold their files. These generous talented designers are willing to share files and yet there are a few who will spoil it for the honest people who appreciate the free files.
Oh Bird this is awful, there is a saying ” not only do they take the eyes, they come back for the sockets” do they have no shame in what they do, I dunno the person you men but I would name and shame so that people who really do like your files for what they are and not to be abused by greed can then NOT BUY THE PRODUCT that is really a stolen idea yup im sooooooo annoyed

Nothing changes, Bird, this has gone on with all crafts – an example, digital scrapbooking went through it several years ago; then there was a nasty time when someone put out on the auction site whole CD’s of files downloaded from UKS (and didn’t even remove the name of the designer if it was on the file!). People often see their stuff on Crafty Bob, too. Some idiots have no scruples – they see generously shared free stuff as theirs to do as they like with. I am so sorry that those who do value your work will be penalised along with the grabbers but I do understand – I was one of the UKS contributors who got ripped off… but we did fight back!!

I’m also so sorry this has happened to you Bird. I’ve had it happen to me in the past when I was selling a file for charity. Some people will go so low you wonder how they can ever get up again!

How mean can some people be when you are so generous with sharing your designs. I am fairly new to silhouette crafting and have very much appreciated receiving your emails and files, and all for free too. I do hope you can stop these people and find a satisfactory solution. I too am really sorry that your kindness in sharing has been abused. If I knew who the guilty party was I would make a point of never buying from them.
shocking – totally shocking. I have only recently found your website and love everything you do. I have made a few of your designs and plan to sell them at craft fairs but obviously the design will be credited to you. I would however be willing to pay for the files in future if that’s what’s needed.

I am so sorry to hear that someone has done this to you. I would understand if you have to start charging for your designs. I never sell any of the things I make. I make them to give away as gifts and just to put a smile on someone’s face. I’m always sending people to your blog when I do a tutorial on how to incorporate one of your designs from my YouTube channel. I asked that they please leave a tip in your tip jar as you are kind enough to put your designs out there for free for people to create. It’s a shame someone would just take advantage of your designs and then charge money for it. It’s just really sad and deceitful for a person to do this. I don’t understand sometimes how people can think they can get away with such things.
Why don’t you consider selling your designs at the Silhouette America Online Store? At least you will make some money from all the designs, and your hard work will not be exploited.
I am sorry to hear this has happened again, your files are lovely and you are so generous as to let us use them for free. I use your files for family and friends cards only and do not sell any but understand you may have to start charging more than I can afford now. I hope you can sue the person selling them illegally or at least name and shame them and any company that did not check whether they had any right to them in the first place then hopefully we can all boycott such despicable people.

You bet it is a kick in the teeth. I just want to say how much I have appreciated your generosity. As a senior on a fixed income for many years now I appreciate how good your files make me look with my family and friends. If they were not free I would not feel comfortable breaking a tight budget to use them. I get great joy creating my cards but only use supplies on hand (adhesive excepted )

People continue to amaze me. I used your trophy card for my Father’s Day card. Both my parents loved it so much they have it displayed in their china cabinet. That has never happened before.

I’ve only been following your site a short while, but my cuts are all for personal use only. I’ve totally appreciated and respect your hard work bring us fabulous files and abide by your terms…I will continue to abide by any new terms in the future. Bird, I am so sorry to hear you are going through this. I have just bought a Silhouette Portrait and was looking for files and came across your brilliant designs.
I would say I cant believe that people would do this but that would be a lie. In this day and age it doesnt matter what we say or do there is always some low life who will happily take what isn’t theirs and claim it for their own. I draw sign language graphics and stopped producing resources because of someone taking my graphics, changing the head and claiming the work as her own.
I nearly had a breakdown over this and had to walk away rather than continue on the path I was on. Take pleasure in knowing that there are many many people out there who truly appreciate what you do and share.
Well, that’s just rotten that you have been taken advantage of. I used to tell my mom in other situations, “there are givers and takers in the world, and you’re a giver”. If someone is intent on stealing your designs, they’ll find a way even if you change the terms.
It is what it is. We’ll still be here……. admiring your cards and being in awe of your designs.

There are only a couple of true artists that still give away quality files for free, so I’ve always been grateful for you and your site. Dear Bird, I am so sorry that anyone would not respect your generosity. My conscience would not allow me to violate this ethic. “IF” I ever want to use one of your images in a product I wanted to sell, I would certainly contact you first to obtain permission and pay you. You deserve this respect and also the monetary returns from all of your hard work. I have read through the comments and noticed a couple that say they will be crediting you as the designer which is great but they also say they sell what they make, am I missing the point here because I thought they were for personal use (making things for gifts)not for profit.
Aargh! Why do people do those things? So sorry that they take advantage of your generosity to make money for themselves. It has been wonderful to have someone share so willingly their talent and I agree, why don’t you hook up with the Silhouette store and make them pay to use your designs. I would be more than willing to purchase them as I do many other designs through the Silhouette store. Blessings!

i know this person ( yes i know who it is ) has also taken files from other designers and recently i got this message from another designer telling me that shes up to her old tricks again
(I see the old dogs back to copying my stuff again and adding it to cup.. along with boxes made with Traced Cheerylyn designs on them x )

Bird I am so sorry that someone has felt that it is alright to take your files and make them their own. You are such a generous and kind person and give so freely. I personally want to thank you for the gifts you have given over the years and make a person vow to use them for only personal use. All that I can say about the others that didn’t respect you is shame shame shame! As well as remind you that karma does exist, they will get theirs.
To hear that someone is taking advantage of your generosity is frustrating to me especially because as a crafter who just enjoys making things and doesn’t sell anything at all, who has found a place to have access to items I couldn’t possibly design myself, may be jeopardized because of one person! I say go after that person – please don’t change the way you do things because of one person. You are kind to do this and hope that you will continue – it is inspiring so many of us to create or even to attempt to create. Thank you for what you do!!!!!!!!!!!!!

I don’t see my cards etc but I’ve just re-read the T&C and notice it says you can sell if you make something but not sell the actual file so apologies for my comment about selling what you make.
I LOVE your files! I do not have a blog nor do I sell my cards. I have made beautiful Thinking of You, Happy Birthday and Happy Anniversary cards using your cut files. The fact that they are free makes the giving even better! Thank you so much!
When I use files or designs created by someone else, I credit the work as “Handmade by” instead of “Designed and Handmade by”. When asked, I ALWAYS give credit where credit is due! To steal someone else’s work is horrible, but to have the audacity to claim same as your own is unconscionable. I hope that you (and no doubt others) are able to stop this thief. Thank you again for sharing your talent.

I believe this because if I didn’t it would be tough to rise each morning. Our Father will sit in judgment of each act against Him no matter how small or large. And to take credit for some one else’s work is a disgraceful act.
There are so many on both sides of the pond who appreciate your creative work and give you the credit. I thank you for all the work you have done to help me create beautiful cards for family, friends and our troops serving over seas far away from family.

Oh Birdy, how awful, I know you have said in the past about people stealing your designs and selling them for profit. I assume it was on the only Crafting TV channel we have, have watched it a lot today, but not seen any cutting designs. Would you not be able to let us know if was this channel? Can we post on that facebook page to let them know how disgusted we all are??
I suspect you’d have to charge a fortune for your designs to deter really nasty crooks like this

It is so sad to have a few ruin it for all of us. You are so talented and have been so generous, it is such a shame someone else is taking advantage. This has happened to another friend and she set up where you wrote to her to get a password to receive the info, and she somehow verified your address, but I imagine that would be a lot of work for you. Thank you for ALL you have shared with us. Hopefully what goes around comes around and what they are doing will come back to them,in a way that will hurt them most.
Other people should not benefit financially from your hard work and generosity. We all share in hoping for a solution to this heart breaking problem.

One tends to think of other crafters as friendly, honest and caring people but obviously not. I so love your designs. Haven’t used that many of them so far but you are a talented lady. Don’t get discouraged.
Why do people have to be so horrible? I’ve loved your files since I’ve found you. I hope this doesn’t stop you from sharing with us one way or the other. So frustrating to know there’s ugly people out there like this in our paper community.

I have ALWAYS enjoyed your files that you have so GENEROUSLY shared with all of us. These people who steal other’s files are despicable & there should be a way to have them prosecuted. This is not fair to you or others who give files. I hope you will continue to make files for us. I am not talented in that way. Thank you for all your files

hi, I am very sorry to see this has happened to you. I love to see your files, and to tell the truth, I have not used them yet,although I do save them. I will get around to using them, when I get time, but I would never sell them. I have never seen a crafting channel, so I would not of seen any of your files. some people are just so greedy and steal others files. It is a pity the person cannot be named and shamed. I do hope there is some way you can complain and stop this abuse.
I have always loved your designs. Unfortunately, there is always someone who has to spoil things for everyone. I don’t sell cards, I only make them for friends and family, and there are so many of them, that I’d never have the time to mass produce! I give my cards away as fast as I get them made! And I’m usually rushing to get the next birthday/sympathy/get well/graduation card made. I have always loved your free designs (you are so talented), but you are also a tremendous source of inspiration to me. I’d hate to see your free designs go away, but I totally understand if you have to charge for them. If someone is stealing your designs, you should really contact the place where you discovered your designs being sold and let them know about it. If it’s someone’s private site, then it might not help much, but you mentioned them making thousands of pounds off your designs, so it sounds like it may be a public sponsored site. If so, the person or company running the site probably would not appreciate someone selling stolen designs and they might kick them off the site if they discover it. Just a thought!
All it takes is one bad apple as the saying goes. You have shared your tremendous talent with so many of us that we are hurt for you. Please let us know who is financially making gains on your designs and I for one will never purchase a thing from them. I know many sites grant limited use permission which only allows not for profit use. Yet others charge small amounts that with a following such as yours should add up to some pretty nice pennies. Don’t let others capitalize on your talents do what you must and know that this faithful follower will continue to use your designs and give you your due credit.
Shame, Shame, Shame on them. Bird, create your own copyright symbol that you can incorporate in all future designs and then lets see who will try to steal from you. Best Wishes

It’s so sad to see what people are willing to do to one another for the sake of a dollar/pound. I do so appreciate all the free files that you have provided. And I wish I, too, could somehow let the thief know how little I think of them. I understand and support whatever you have to do.
I’ve recently become a follower of yours as I have just received a Cricut Explore as a gift. I really do appreciate that your files are all free and they are all in a named directory so that I remember to credit you and they are only for personal use. It has helped me a lot but understand that things have to change. It’s all about greed for some people, those without morals. I do hope you manage to sort it all out.

Really sorry to hear this. I love your designs and when i download them I make sure they go into my” others cutting files” rather than”my cutting files” and label them as by you. I don’t sell cards but just in case I do in the future I want to make sure that I keep them safely separate.
Im so sorry, I feel so angry and upset for you. You should publish the name of the site selling so we can all call them and see if they can stop selling your files. Or the person selling them;s name, there must be something you can do to stop them or at least show them up for the thief they are. I love your files but totally understand and am behind you all the way in whatever you decide to do.

This makes me really irritated. You have always been so giving and generous with your beautiful designs. I don’t know how someone could turn around and makes 100s and sell them. I love having the free files, but I will understand if you must charge for them. It’s really such an unfair treatment of you.

I think that is disgusting that someone is taking your creativity and selling it as their own! You mentioned that you saw your files being sold on TV. Maybe you could give us(all your loyal followers) the ordering/mailing address and we can all send a very NASTY letter to this person. Maybe if she gets enough “hate mail,” she’ll think twice about doing it again!

Bird this is what Lawyers are for. Sue the pants off them for your files and be compensated and make them stop selling in the deal too. This is so rotten, but I have caught a few doing it too. I tell the person who made the file so they can take action to get it stopped. I hope you can get them stopped and hey if they feel okay to sell your files you might be okay to let everyone know who they are so we can not buy anything from them Ever!

I,ve often saved and used your free files, and been very grateful for them. I can’t believe that yet again in the craft world this awful behaviour is happening again. These people should be named and shamed! Completely understand if you have to change your policies and terms of use.

I firmly believe if someone is good enough to help others by free files and such then they should be credited for them, and if people go out to make themselves money by using anything which has been given freely to help not just one person but loads of people then it is only right that the proper person/designer should get the credit for it and in cases like this should be the one to receive the praise for it and any money gained. What that person is doing is not only lying but thieving aswell, I hope there is something else you can do other than changing the wonderful site you have.
I have only recently got a silhouette and even though I have only got the smaller one I have used used your site to help me to understand the way it works, I don’t sell my cards but if I was to use anyone’s designs for any reason I would let them know and do things in the correct manner. I hope you can let me and all your other grateful friends know who it is that is using your designs for their own gains so we can hopefully make sure we don’t use that person/ company for anything in the future. Thank you once again for all help you have given me.

Oh that’s terrible but not surprising, you are a great designer and it was only a matter of time before some low life took advantage, a few years ago I made some files to add to a cutting file disc that was sold to raise money to stamp this sort of thing out but you can’t stop it there’s always someone ready to take advantage. I love your emails and get excited about the content so I really hope you don’t stop your awesome work.

It is so wrong! I love your designs and if I use them, of course I will say it is yours.
So UNFAIR and ugly. I know one lady who copies yours and many other free designs, change them just a bit (maybe adds one layer) and calls them her designs and sells them with “this is mine, do not copy or sell, or I will get you in court”.
Could you be so kind and let us know what was the programme in telly, because you should be strong and name and shame.

I used to create iris folding patterns and sell them on a CD, and you wouldn’t believe the things that happen, people sell copies on ebay, and others pass the patterns to others etc. etc. I would see cards made up from my patterns on the internet and I know they weren’t people who had purchased my CD, so they had got them illegally from someone else who was passing them on or selling them. If I saw a listing on ebay with my patterns on I would TELL them, not ask them, to remove it immediately, and that usually worked.

It is truly disappointing that so many don’t respect others work, whether it is cut files or digital images. It seems like an epidemic lately with files being shared or used to further someone else’s interests. Understand if you have to start charging or changing your terms of use.
I can’t believe someone would have the bare faced nerve to do this to anyone, but especially you. I have been following your designs and blog for years, have used many of your designs for items made for my family for all kinds of celebrations. I don’t sell items made with your designs and the thought that someone would actually have the nerve to sell your files directly on tv…..well….I am flabbergasted so can only vaguely imagine what you are feeling right now. I agree with a comment earlier and I think you should inform the tv people. I am sure they won’t want to be dragged into anything like this, they have their own reputation to think of. Name and shame.
Is there a way that you can copyright your designs? Although I would think that you have proof of your ownership because your blog is dated and shows when it was published. I would prosecute whoever is stealing your designs and take them to small claims court. You have so many fans and to have one evil person ruin it for everyone is terrible. I am so sorry but you do what you must to protect yourself.

I am retired due to health reasons, so I am one of many who so appreciate your generosity as it allows us to continue doing something we love for FREE! Bird isn’t there someway you could get them in court and get what is plainly due you? I would not rest until I brought them to justice. Just the fact that they handled it the way they did. They could have been much more gracious. This is an outrage and please please do not let them profit from your hard work. Your files are gorgeous and I love them I try to check your site daily I just can’t believe someone would do this to you. I am so very sorry.
Bird, I cannot believe that Ali & Paul Reeve are selling your designs on TV as their own, admitted to you that they did use YOUR designs and then try to justify it by “placing the blame” on you for not listing your terms of use!!
These people are HORRIBLE and need to be stopped!!!!! If I were you, I would definitely contact the TV show that they were on and explain that the Reeve’s stoled your designs and send them a copy of the emails from the weekend. The TV network is not going to get involved in a copyright infringement and will most likely terminate them from any future appearances. I’m sure your designs are NOT the only
ones they are unlawfully using.
I do not know what the law is where you live but it wouldn’t hurt to consult an attorney. You may be eligible for compensation from them.

FYI I ALWAYS understood your “terms of use.” There was no confusion with your wording!! Almost every site where templates, digi stamps, etc are shared, there is a “terms of use” statement. I would NEVER EVER steal another person’s designs and take credit for them, let alone sell them!!! This situation is just awful!!! It’s disgusting that the Reeve’s have no conscience!

I cannot believe the arrogance of the Reeves. You not only deserve an apology but also compensation for your work. I have respected your creativity and appreciated the sharing of your beautiful designs. I would never have expected anyone to be so low as to blatantly rip you off and then televise the act! I will never watch that show, let alone purchase anything they have to offer.
I do not understand how these people can sleep at night. I am sure they knew what they were doing, if they didn’t why would they even bother changing the design just a little as they admitted? Food for thought.
I have enjoyed seeing what you come up with for designs. I honestly do not do a whole lot with my machine but when I do I search through your vast library.
There are so few artist left that are as willing as you are to share with people and I can sure understand why.

I have been around in the graphics world for years (not cutting files) and its the same old story. I have never understood what glory there is in STEALING someone else’s designs. I love the fact that we all know who these people are and hopefully no one will buy anything from them. They have no integrity! If there is anything I can do please let me know.

I’m so sorry to hear all of this. I craft for personal use only, and love your designs — you are so talented……When any fellow papercrafter remarks on something I’ve made using your files, I tell them right away where it came from…..So thankful that you share your creative genius, you have no idea.

Bird, You must contact the station and your local police and let them know they were stolen. How you can prove it is simple. All files on a computer are time stamped. You must have the original file saved on your computer with the software you made it with. If someone stole your files have them produce the original file. If they got it from you there date would be newer. I also saw that there is a free copyright site that some other designers have been using. I remember reading it on there blog. I don’t know what software you are using but programs like Adobe inbed creation information that only you can see. If it was on TV you have a great case. I love your files and I appreciate them for cards that I make for my friends. It would be a tragedy for you not to continue to share your beautiful work make the person pay both legal and financiaL . The station should also be liable for selling stolen files. Go after them girl. I am sure we would all donate a little something for you to fight. You go girl.

Your terms of use are quite simple, straight forward, and given the generosity of freedom you give to use your designs I am to say the least disgusted with this event. Would it have been too much trouble for Ali to have mentioned where the design came from on air? And as you rightly said, just to admit their error and apologize would have been nice. These people are supposed to be professionals , but I see no professional conduct or respect here. I am so sorry that you have had to endure this and I wish I could apologies for them……….my opinion of Ali has just been changed, it just goes to show that people get greedy and selfish at the top!
